1. Introduction
This website and/or our mobile applications (“Elva Weddings”) is owned and operated by Elva Weddings, an individual operating as a business (“Elva Weddings,” “us,” “we,” or “our”), located in Salt Lake City, Utah, with participation by various vendors offering products and services via Elva Weddings.
These Terms of Service apply to your use of Elva Weddings and any services, functionality, or offerings where these Terms of Service are linked (collectively, “Services”). Your use of Elva Weddings and the Services is conditioned upon your acceptance of these Terms of Service. If you do not wish to be bound by these Terms of Service, please do not use Elva Weddings or the Services. You may not use our Services if you are under 18 years of age. We may update these Terms of Service from time to time in our sole discretion, in which case we will post the revised Terms of Service here.
These Terms of Service apply to all visitors and users of our Services, including but not limited to registered users, guests, and vendors with listings on our vendor marketplace (“Vendors”), but some provisions may apply to each party differently.
Your use of Elva Weddings and the Services is further conditioned upon your acceptance of our Privacy Policy, which is located at our Privacy Policy page. Your continued use of the Services constitutes your agreement to the Privacy Policy. You consent to any Personal Information we obtain about you being collected, stored, and otherwise processed in accordance with the terms of our Privacy Policy. If you provide Elva Weddings with Personal Information of others, such as your partner and/or guests, you represent that you have obtained permission from such persons to share such information with us. These Terms of Service are intended to be read together with our Privacy Policy.
2. User Submissions and Content
You represent that all of the information, data, and other materials you post, upload, transmit, share, or otherwise provide through Elva Weddings or the Services (“User Submissions”) are true, accurate, and complete.
The materials displayed on Elva Weddings (including, without limitation, text, graphics, logos, icons, images, videos, and User Submissions) (“Content”) is the exclusive property of its owner (Elva Weddings and/or its licensors and other content providers, “Content Owner”) and is protected by copyright and trademark law. You may not sell, reproduce, distribute, or otherwise use any Content in any way for any purpose without the Content Owner's prior written consent.
For All Users:
By submitting User Submissions to Elva Weddings, you grant us a worldwide, royalty-free, non-exclusive, perpetual, and fully sublicensable license to use, reproduce, publish, and display such User Submissions for the purpose of operating and promoting Elva Weddings and its Services. Any Content you transmit or post may be used by us or licensed to others by us for any purpose whatsoever.
You are responsible for your own User Submissions. You may not upload or publish any User Submission that: (i) is copyrighted without permission; (ii) is obscene, defamatory, threatening, or harassing; (iii) is an advertisement, “spam,” or any form of commercial content; (iv) impersonates another person; (v) contains viruses or other harmful code; or (vi) violates any applicable laws or regulations.
We do not screen communications in advance and are not responsible for monitoring any Content posted by users. We reserve the right, in our sole discretion, to remove any Content for any reason whatsoever at any time without notice, including for violating these Terms of Service.
3. Use of Elva Weddings and the Services
Subject to your compliance with these Terms of Service, we grant you a limited license to access and use Elva Weddings and the Services. You are solely responsible for compliance with any and all applicable laws and regulations that may apply to your use. We strictly prohibit any use of the Services that is in violation of such regulations, including: (i) any unauthorized use of Content; (ii) any use of hardware or software intended to obtain any information from the website; or (iii) any action that interferes with the proper working of our infrastructure.
You are responsible for obtaining access to the Services. Any unauthorized access to Elva Weddings by you shall terminate the permission or license granted to you.
4. Planning Tools
If you have registered an account, you may have access to our free planning tools for your personal, non-commercial use. This may include features such as a guest list, personalized website, or checklist.
By using these features and uploading guest information, you represent that you have the permission and consent of that individual to provide the information to Elva Weddings and that we have permission to send emails and/or text messages to the individual on your behalf at your request.
5. Vendor Marketplace
Our Vendor Marketplace allows registered users to connect with Vendors. As a Vendor, you agree that any profile information you post constitutes a User Submission and must comply with these Terms of Service. You also agree not to engage in any tactics to circumvent our platform, such as encouraging users to make connections outside of Elva Weddings.
6. Disclaimer of Warranties; Limitation of Liability
The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, Elva Weddings disclaims all warranties.
You agree that Elva Weddings shall not be liable for any damages of any kind, including direct, indirect, incidental, punitive, or consequential damages, arising from your use of the Services. Your sole remedy for dissatisfaction with the Services is to stop using the Services.
7. Governing Law
These Terms of Service are governed by the laws of the State of Utah without regard to its conflict of law provisions.
